Abstract

Gary Waterman owned a Mack truck equipped with a large water tank. His job was to keep dust down by watering the roads during roadbuilding, hence his name as anonymized. Gary’s client, the road builder, complained about Gary’s truck leaking oil on the roadway so Gary took his truck to Car-Bunc Pty Ltd to get the leaks fixed. On completion Larry Parker, principal of Car-Bunc Pty Ltd, handed Gary a bill of nearly 20,000 dollars. Gary refused to pay and Larry sued for the money. Larry did not show up to give evidence but sent a letter to the court instead. Her Honour was not impressed and awarded Gary $4000 for his troubles and ordered retrieval of the truck from the premises of Car-Bunc Pty Ltd.
